Secured $7.2 Million Resolving Alleged Monopolization of Oncology Services

For plaintiff Monmouth County, New Jersey, Robins Kaplan filed an amended class action complaint against a Florida cancer treatment center, Florida Cancer Specialists PL and its president (“FCS”), alleging that FCS had colluded with a rival, 21st Century Oncology LLC, to allocate markets and to monopolize oncology services in Southwest Florida. The lawsuit, originally filed in March 2018, alleges that the treatment centers unlawfully agreed that: (i) FCS would refer radiation oncology patients exclusively to 21st Century, and 21st Century would refer medical oncology patients exclusively to FCS, and (ii) FCS would acquire the medical oncology business, and 21st Century the radiation oncology business of a third competitor, thereby allowing FCS and 21st Century to monopolize relevant oncology services submarkets in Southwest Florida. Plaintiffs negotiated a nearly $7.2 million settlement with FCS which was granted final approval in March 2020.
